Monday Morning Memo----------------May 12th

Good Morning:

More than 100 people attended and enjoyed the Hospitality Committee’s Cinco de Mayo fiesta at Sunset Ramada. It was a very big hit with the attendees, who enjoyed a wide variety and a delectable array of homemade Mexican entries of every description, margueritas by the pitcher, desserts, and all manner of good things to eat and drink. The Ramada was festively dressed in appropriate attire, and a piñata hung from one of the beams--and was broken by one of the guests after several had tried their luck. The weather held beautifully and the evening couldn’t have been much more pleasant. Our thanks go out to the committee for their sponsorship of the event, and for all the set up and cleaning up that always goes with it. Thanks is also extended to all of the guests who brought their special dishes to share with their neighbors. Pictures of this event will appear in the next Periodico.

The Cinco de Mayo evening was the 9th major event by our Hospitality Committee so far this year at Sunset Ramada, with attendance averaging 100 people. For those who have lived in EE for a few years, this is an unheard of record, but attributable to the fact that we now have a place to gather and a hard working team who make our gatherings so pleasant. Hats off to our Hospitality Committee!

Problems with the pool chemistry were reported this week. The situation was turned over to our professionals for handling, and have been dealt with. Unfortunately these things occur now and again with any swimming pool, and there are just no preventative measures that can be taken to avoid them.

The chemistry of our pool is taken twice daily by volunteers, and three times weekly by our pool company professionals, and we still have problems occasionally.

The link to the firm that can provide a report on Audrey Ware, as provided in the last week’s MMM, did not work for all subscribers to the Memo. As previously reported, Audrey is ill, and we are sure would enjoy your messages left at Caringbridge. She has been a very good friend of Esperanza Estates for many years, and even more importantly, a wonderful friend to all who know her. We wish Audrey our very best for her recovery, and we send our best wishes to her family for their strength in coping with this time.

The May Board meeting will be held next Monday, May 19th, at Sunset Ramada beginning at 1:00 pm.

Work continues on the new plantings bed behind the new EE sign on Portillo. Some desert plantings have been made, and our resident stone artist (Stoney Brown) has also been at work. Stop and take a look.

The HOA has completed repair work on a couple of quad driveways needing attention.

Mandatory perpetual membership in GVR is controversial for some. Accordingly, an announcement which may be of interest is appended to this Memo for those who may be concerned. Esperanza Estates is not a mandatory GVR subdivision. If you have GVR on your home in EE, it is because you or some prior owner joined it.

GVR Claim of Perpetual Lien To Be Challenged

If you live in a non-GVR subdivision, but have the GVR perpetual membership lien on your home and wish to quit GVR, you may be interested in this announcement.

Extensive legal research, concurred in by Tucson legal counsel, suggests that the claim of GVR that membership in the organization cannot be terminated, is false and cannot be legally sustained.

A group of Green Valley residents intends to employ legal counsel and challenge GVR in court. If successful, members joining the suit will be able to quit GVR, thereby eliminating the requirement to pay future dues. A monetary claim against GVR for refund of previously paid membership fees may also be joined in this legal action.

Persons interested in this proceeding are being solicited as additional plaintiffs. This will involve a commitment for paying a pro-rata share of the costs of the action. The amount of the costs is indeterminate at this time and will depend on a number of factors; however, the more plaintiffs, the less will be the costs per individual. Bear in mind the annual GVR dues are nearly $400 currently, and it is a certainty they are not going to go down in the future. Unless this lien is broken, you will be paying this forever--as will future owners of your home--even if they don’t desire to belong to GVR. Many believe membership in GVR is a detriment to the sale of your home.

Persons interested in joining in this proceeding are asked to write to 217 W.

Cedro, Green Valley, AZ 85622, stating their name legal name--(both husband and wife if the property is in joint ownership), address, telephone, and a written statement they have read this announcement and wish to join in the litigation. As with any litigation, there is no guarantee of success, but prospects have been carefully evaluated and appear quite favorable and that the action is likely to be successful.

Persons residing in GVR subdivisions are not eligible to join in this action. You are in a GVR subdivision if membership in GVR is required in your CC&R’s.
